What makes this case so alarming is not simply the severity of the sentences being sought, but the principle at stake. If activists can be tried before a jury for criminal damage while facing sentencing frameworks associated with terrorism, without the jury being informed of that possibility, the distinction between ordinary criminal law and counter-terrorism law begins to blur. Whatever one’s view of Palestine Action, creating precedents that expand exceptional powers into ordinary political protest should concern anyone who values the rule of law.
'Justice' system corruption occurs more frequently than we can ever know about; and any wrongful charge, trial, conviction and punishment should be concerning to any law-abiding person.
I've noticed that people tend to think that suffering any such ethically challenged courtroom conduct will not happen to them. However statistically unlikely, the average person could someday find themselves unjustly accused and sentenced.
Meantime, whenever I hear/read about how relieved people are when someone is charged with a serious or reviled crime — ‘Did they catch him? They did? Well, that’s a relief!’ — I mentally hear the phrase: ‘We’ll give ’im a fair trial, then we’ll hang ’im.’ And if I point out he may be the wrong guy who’s being railroaded, I’ll sometimes receive the erroneous refrain, ‘Well if he’s truly innocent, he has nothing to worry about.’
